JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioners being the maternal uncle and aunt of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A and 406 of the Indian Penal Code, Section 3/4 of the Dowry Prohibition Act and Section 3 of the Protection of Women From Domestic Violence Act.
The accusation is of torture.
It is submitted by learned counsel for the petitioners that the thrust of accusation is against the husband of the informant, though, a case was also filed from the boys side against the informant's family making accusation under Section 366A and
Patna High Court Cr.Misc. No.10639 of 2015 (2) dt.24-04-2015 2/2 365 of the IPC.
Considering the thrust of accusation against the husband of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Lakhisarai in connection with Barahiya P.S. Case No. 40 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
