The petitioner seeks bail in a case registered under Sections 420, 406, 467, 468, 409, 120B/34 of the I.P.C. Allegation is that the accused persons misappropriated Rs.1,33,000/- of the informant after hatching conspiracy. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.02.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The main allegation is against co-accused, namely, Ratan Kant Jha, who after committing the crime has committed suicide.

On behalf of the State, it is submitted that the

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned P.K. Tiwari, J.M. 1st class, Kishanganj in connection with Galgalia P.S. case No.10 of 2018.
