This is a case registered under Section 30(A) of the Bihar Prohibition and Excise Act.

Counsel for the petitioner denies the allegation of recovery of 9 litres of liquors and submits that he has been made accused in the case only on the basis of suspicion. He further submits that the petitioner has no criminal antecedent prior to the instant case and that he is not a member of any group. The allegation made in the FIR is general and omnibus. The petitioner is in custody since 27.04.2017.

In the facts and circumstances of the case, prayer for

Patna High Court Cr.Misc. No.28720 of 2017 (2) dt.01-07-2017 2/2 bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II - cumSpecial Judge, Excise Act, Sitamarhi in Case No. C-2/261 of 2017.
