Heard the learned counsel for the petitioners as well as the learned APP for the State.

At the outset, the learned counsel for the petitioners has submitted that petitioner no. 1, Suresh Ram has been arrested and, as such, the application has become infructuous with respect to him. He, therefore, seeks permission to withdraw the application with respect to petitioner no. 1. In view of the aforesaid submission, the application

Patna High Court CR. MISC. No.35832 of 2022(2) dt.13-07-2022 2/2 is dismissed as withdrawn with respect to petitioner no. 1. So far as petitioner no. 2 is concerned, the present application has been filed for modification of the order dated 02.05.2019, passed in Cr. Misc. No. 16267 of 2019, by which the petitioner was granted anticipatory bail. For the reasons disclosed in the application, it is allowed and the time granted by order dated 02.05.2019, passed in Cr. Misc. No. 16267 of 2019 for surrender of the petitioner no. 2 and furnishing bail bond is extended by four weeks from today, subject to deposit a cost of Rs.1,000/- to the District Legal Services Authority. At the time of surrender, the petitioner shall furnish the receipt showing deposit of Rs.1,000/- to the District Legal Services Authority.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
