JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code and Section 33 of the Indian Forest Act. The accused persons were loading stolen wood on a tractor and as soon as the informant reached on the place where the wood was being loaded, the accused persons managed to flee away.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR, subsequently, the name of the petitioner sprang up on the statement of the father of the owner of the tractor as the driver of the alleged tractor. The aforesaid facts constitute ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.15775 of 2015 (2) dt.16-04-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Dulhin Bazar P.S. Case No. 138 of 2014 pending in the court of learned JM, 1st Class, Danapur. Accordingly, the application is disposed of.
