This is a case registered under Section(s) 302/34 of the Indian Penal Code and Section 27 of the Arms Act in connection with Noorsarai P.S. Case No. 284/2016, corresponding to S.Tr. No. 322/2017.

From the F.I.R. it appears that co-accused Shrawan Yadav and Dinesh Yadav along with some other co-accused resorted to firing leading to death of Shivendra Prasad, Mukhiya of Nisur Panchayat and Ashok Prasad.

Learned counsel for the petitioner submits that the petitioner was in custody in connection with Harnaut P.S. Case No. 337/2016 and from that case, on the basis of his confessional

Patna High Court Cr.Misc. No.30107 of 2017 (2) dt.06-07-2017 2/2 statement, he has been remanded on 28.02.2017 in this case. Even though he is not named in the F.I.R. and there is no allegation against him in the F.I.R. It is further submitted that other coaccused persons, against whom overt act has been alleged in the F.I.R., have already been granted bail vide orders dated 18.05.2017 passed in Cr. Misc. No. 21577/2017 and dated 12.05.2017 passed in Cr. Misc. No. 18713/2017. Some other accused persons have also been enlarged on bail in this case. Considering the above submissions, prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional District & Sessions Judge, Biharsharif, Nalanda in connection with Noorsarai P.S.
