JUSTICE SATYAVRAT VERMA ORAL ORDER 29-07-2024 Heard learned counsel for the petitioner, learned APP for the State along with learned counsel appearing on behalf of the O.P. No.2.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 498A of the IPC and Section 4 of the D.P. Act.

3. The learned counsel for the petitioner submits that in compliance of the order dated 01.07.2024 the petitioner has already paid an amount of Rs.1,50,000/- to the O.P. No. 2 and has also started paying the maintenance amount of Rs.6000/- which was directed to be paid by the learned Principal Judge,

4. It is next submitted that the left over arrear shall be paid within a period of nine months from today i.e. the entire arrear would be paid on or before 10.04.2025, but the maintenance as directed by the Family Court shall be paid regularly.

5. The learned counsel appearing on behalf of the O.P. No.2 also does not dispute the said contention of the petitioner that an amount of Rs.1,50,000/- has been paid to the O.P. No.2 and the O.P. No.2 is also getting the monthly maintenance, but then submits that nine months period for arrear is to long a time, on which the learned counsel appearing on behalf of the petitioner submits that the amount of arrear shall be paid on or before 09.01.2025, the learned counsel for the O.P. No.2 does not dispute the said submission.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., East Muzaffarpur in

7. However, it is made clear that the O.P. No.2 shall be at liberty to file an application before this Court seeking cancellation of the anticipatory bail granted to the petitioner, in the event, if the petitioner does not pay the arrear amount on or before 09.01.2025 or the amount of maintenance as directed by the family court is not paid for two consecutive months.
