The petitioner seeks regular bail in connection with Samastipur Town P.S. Case No. 77 of 2017 dated 29.3.2017, G.R. No. 817 of 2017, registered for the offence punishable under Sections 379 of the Indian Penal Code.
The accusation is with regard to theft of the mobile phone of the informant. It has come to the light during the course of investigation that the petitioner was nabbed in another case wherein he confessed to have committed theft of the said mobile. Learned counsel for the petitioner submits that the said mobile has been recovered from the house of the father-in-law of the petitioner and not from the house of the petitioner or from his
Patna High Court Cr.Misc. No.29150 of 2017 (2) dt.01-07-2017 2/2 person. It has been further submitted that the petitioner is in custody since 4.4.2017 as well as he may be enlarged on bail since the offence is not very serious in nature.
Having regard to the facts and circumstances of the case, more particularly the fact that the petitioner is of tender age, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Samastipur Town P.S. Case No. 77 of 2017 dated 29.3.2017, G.R. No. 817 of 2017.
