This is a case registered under Section 395 of Indian Penal Code.
Counsel for the petitioner submits that on the basis of confessional statement made by co-accused Sanjay Paswan, the petitioner has been falsely implicated in this case. He further submits that investigation was completed and charge sheet has been submitted so there is no scope of tampering the investigation. He also submits that on the basis of such statement which has no evidentiary value, he is languishing in jail custody since 23.02.2017.
In the facts and circumstances of the case, prayer for
Patna High Court Cr.Misc. No.28766 of 2017 (2) dt.01-07-2017 2/2 bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Narpatganj P.S. Case No. 83 of 2017.
