In this case, the petitioner is seeking bail in connection with Sessions Trial No. 527 of 2019 arising out of Karja P.S. Case No. 154 of 2018 registered for offences under sections 304(B)/34 of the Indian Penal Code.
In the present case, the petitioner is the husband of the victim lady.
As per allegation, the accused persons forcibly administered poison in the person of the victim due to which she died.
The marriage of the victim girl was solemnized with the present petitioner on 11.5.2018 and just within 2.5 months, the occurrence has taken place. Allegation of demand
Patna High Court CR. MISC. No.11317 of 2020(4) dt.26-08-2020 2/2 of dowry has also been made against the accused persons including the petitioner.
Learned counsel for the petitioner submits that the father of the victim has come to the court and has filed an application stating that there was no demand of motorcycle and has stated that actually she has died out of vomit and dysentery on account of food poisoning.
It is nothing but tampering with the evidence. This Court is not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner, above named, is rejected with a direction to the court below to expedite the rial and conclude the same within a period of 1.5 years from the date the normal court proceedings initiates. (Shivaji Pandey, J) rishi/- U T
