The petitioner apprehends his arrest in connection with Azamnagar (Salmari O.P.) P.S. Case No. 315 of 2020 registered under Sections 341, 323, 324, 307, 354, 379/34 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that the petitioner is innocent and has falsely been implicated in the present case due to previous enmity and land dispute. Further submission is that petitioner has no criminal history. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that there is direct allegation against the petitioner of assaulting the

Patna High Court CR. MISC. No.23865 of 2021(5) dt.25-04-2022 2/2 informant with iron rod on her head and the injury report also corroborates the same. Hence, this is not a fit case of anticipatory bail.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
