JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-08-2017 The petitioner has questioned the order, dated 16.03.2017, passed in Criminal Appeal No. 04 of 2017 by learned Sessions Judge, Bhojpur, Ara, whereby his appeal against an order, dated 31.08.2012, passed by the Juvenile Justice Board, Ara, rejecting his application claiming juvenility has been rejected on the ground of limitation.
Learned senior counsel appearing on behalf of the petitioner submits that the petitioner finally stood convicted of the offence in a proceeding arising out of Chandi P.S. Case No. 31 of 2011 against which appeal is pending before a Division Bench of this Court registered as Criminal Appeal No. 04 of 2017. In that background, learned Senior counsel seeks permission to withdraw this application so that he may assert the
petitioner's claim of juvenility before the Division Bench. This application is permitted to be withdrawn with the liberty aforesaid, if permissible under law.
