The petitioner seeks bail in a case instituted for the offences under Sections 372, 373, 376, 506/34 of the I.P.C. as well as 3, 4, 5, 6 of the Immoral Traffic Prevention Act, 1956 and Sections 37(d), 56(e) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is that she was doing illegal work of flesh trading. Four disposal glasses and two empty bottles of 375 ml wine, condoms and sexual enhancement tablets were found.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.11.2017 and has got no criminal antecedent. Charge sheet/prosecution report has been submitted

Patna High Court Cr.Misc. No.9012 of 2018(3) dt.09-03-2018 2/2 in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim in her statement recorded under Section 164 Cr.P.C. has not supported the allegations made in the F.I.R. It is further submitted that the petitioner may be released after completion of six months in custody from 26.11.2017.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. She has been implicated in a case relating to immoral traffic act and is alleged to have been running a brothel where girls were being compelled to participate in flesh trade.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail after completion of six months in custody from 26.11.2017 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhagalpur in connection with Kahalgaon P.S. case No.651 of 2017.
