JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 11.5.2017, seeks bail in Katoria PS Case No. 50 of 2017 registered under Sections 8, 23(B)(ii)B of the NDPS Act.

It is submitted that the petitioner was driver of the vehicle and had no knowledge of keeping of three bags of ganja, total quantity said to be 3 KG in all the three packets and this petitioner is in custody since 11.5.2017. It is further submitted that the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Md. Shahnawaz @ Shahnawaz is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of lst Additional Sessions Judge, Banka in connection with Katoria PS Case No. 50 of 2017 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) the petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
