Petitioner is in custody in connection with Bhabua P.S. Case No. 319 of 2019 bearing Sessions Trial No. 293 of 2019 for the offence under sections 302/34 of the Indian Penal Code and Section 27, 25(1-b)a,26/35 of the Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
In this case, the petitioner was named in the FIR. His name surfaced on the basis of clue given by the spy to the police.
Learned counsel submits that the petitioner is in custody since 11.6.2019.
Considering the fact that petitioner was not named in
Patna High Court CR. MISC. No.11275 of 2020(3) dt.01-06-2020 2/2 the FIR and his name surfaced on the basis of clue given by the spy to the police and he has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Xth, Kaimur at Bhabua, in connection with Bhabua P.S. Case No. 319 of 2019, Sessions Trial No. 293 of 2019 subject to the condition that on release the petitioner shall render his service as volunteer in dedicated Covid hospital for a period of one month and he has to report to the Nodal Officer in the concerned region who shall utilize the service of the petitioner appropriately.
