The petitioner seeks regular bail in connection with Sabour P.S. Case No. 28 of 2021 dated 19.01.2021 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.01.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that total 135 litres foreign liquor has been recovered. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Case No. 28 of 2021 subject to the condition as laid down under Section 437
