Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 419, 420, 406, 467, 468, 471, 120B/34 of the IPC.
Allegedly, a misappropriation of around Rs.7,86,478/- has been committed by the petitioner in the audit of records during his services in the Sri Rani Saraswati Vidya Mandir School,
Patna High Court CR. MISC. No.24081 of 2021(3) dt.04-07-2022 2/2 Forbesganj.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioner has no criminal antecedent.
Vide order dated 18.05.2022, petitioner was granted provisional bail by a co-ordinate Bench of this Court and case diary was called for. The same has been received. From perusal of the case diary, it is clear that the petitioner has been dismissed from his services, as such, the provisional bail granted to the petitioner vide order dated 18.05.2022, in connection with Forbesganj P.S. Case No.839 of 2020, is hereby confirmed, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
