The petitioners have preferred this application for grant of regular bail in a case registered under sections 272, 273 and 120B of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 11 cartons each having 48 bottles of 180 ml. of liquor was recovered from the house of the petitioner no.1.

It is submitted by learned counsel for the petitioners that the petitioner no.3 happens to be the wife of petitioner no.1

Patna High Court CR. MISC. No.13927 of 2022(2) dt.17-05-2022 2/2 while petitioner nos.2 and 4 are their daughter-in-law. No incriminating article has been recovered from the petitioners house and they have been falsely implicated in the case. They have no criminal antecedent and are in custody since 20.12.2021.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioners not having any criminal antecedent and having remained in custody for 4 months, the Court directs the four petitioners to be enlarged on bail in connection with Bochahan P.S. Case no.367 of 2021 (G.R. no.2690 of 2021) on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no.1, Muzaffarpur.
