JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/149/341/323/504/307/379 of the Indian Penal Code. It is alleged that when son of the informant wanted to sit on the vehicle, which was going in a procession for emersion of idol Saraswati, which was protested by the accused persons leading to assault to the son of the informant when informant went to rescue he was also assaulted. Subsequently, the accused persons entered into the house of the informant, assaulted the wife of the informant and other family members and took away
Patna High Court Cr.Misc. No.15060 of 2015 (6) dt.14-05-2015 2/2 household articles from the house.
It is submitted by learned counsel for the petitioners that for the petty dispute accusation has been levelled. Though four persons received injury but superficial simple in nature. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No.16 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bond of the petitioners will be accepted by the learned court below on verification of the fact that none of the injured received grievous injury, otherwise the petitioners will surrender and pray for regular bail.
