Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 354(B), 379, 324, 504 and 506/34 of the Indian Penal Code, registered in connection with Sakatpur P.S.Case No. 42 of 2021.

As per allegation, when the informant prohibited the petitioners to erect pillar on his land, they assaulted him and his

The specific allegation against the petitioner no.1 is that he assaulted the informant with iron rod and petitioner nos.2 and 3 assaulted Lakho Devi, the daughterin-law of the informant. The accused persons also outraged her modesty and they snatched the gold chain and mangalsutra from her neck.

The learned counsel for the petitioners has submitted that both the parties are agnates. The informant and petitioner no.1 are step brothers and there is land dispute between them. Petitioners are the persons of clean antecedent and the injuries suffered by the informant and his daughter-in-law are simple in nature.

On the other hand, learned APP has opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Darbhanga in connection with Sakatpur P.S.Case No. 42 of 2021, subject to the conditions as laid down under Section

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
