====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Belaganj P.S. Case No. 355 of 2018, instituted for the offence under Section(s) 379, 356 and 411 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 13.12.2018 having clean antecedent. It is alleged in the written report that informant was going to Gaya along with his wife for marketing. He reached near Fatehpur Tubewell, one boy overtook him and snatched the purse of his wife containing cash, two Mobile Phones, key etc. It is further alleged that boy was apprehended near Railway Gumti and handed over to the police. He disclosed his name as Harish Alam (petitioner). On search, one mobile

Counsel for the petitioner submits that some altercation took place between the petitioner and informant in course of driving the vehicle. He further submits that petitioner has been falsely implicated in the instant case. Petitioner is in custody since 13.12.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Gaya, in connection with Belaganj P.S. Case No. 355 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
