In this case, the petitioner is seeking anticipatory bail in connection with Barhara P.S. Case No.08 of 2016, registered for the offence punishable under Sections 379, 435, 504, 34 of the Indian Penal Code.
As per the F.I.R, the paddy of 20 bighas of land harvested and kept at the door of the petitioner. Allegation has been made against the petitioner that he committed theft of said paddy and set the paddy straw on fire.
Learned counsel for the petitioner submits that the land belongs to the petitioner. The paddy was kept at the door of the petitioner, which itself suggest that he is the owner of the land
Patna High Court Cr.Misc. No.9963 of 2016 (2) dt.03-03-2016 2/2 and so much so that the petitioner is the Development Officer in the Life Insurance Corporation.
Looking to the nature of allegation and the facts and circumstances of the case, in the event of arrest or surrender within three weeks from today, let the petitioner-Bibhas Kumar Roy @ Bibhash Roy, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Purnea, in connection with Barhara P.S. Case No.08 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U
