The petitioner is apprehending his arrest in connection with Hisua P.S. Case No. 402/2022 dated 14.07.2022, registered for the offence punishable under Sections 30(a) pending in the Court of learned Exclusive Special Judge, 1st Nawada.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the

Patna High Court CR. MISC. No.13632 of 2023(2) dt.29-04-2023 2/2 order, preferably, on the same day, without being prejudiced by this order considering this fact that petitioner is made accused in the present case because he is the owner of the poultry farm and the motor-cycle from which the illicit liquor was recovered does not belong to the petitioner.
