Petitioner, already in custody, seeks bail in connection with Naya Ram Nagar P.S. Case No.79 of 2017, giving rise to Sessions Trial No.277 of 2017, registered under Sections 341, 323, 307, 302 and 504/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that Mukesh Das, Pankaj Das and Pawan Das opened fire causing death of the deceased Raghu Das as one shot hit at the right side of the face and Pawan Das again fired which hit on the leg of the informant's nephew. Learned counsel for the petitioner submits that there is general and omnibus allegation against three persons of opening fire but only one fire arm injury was found on the person of the
Patna High Court Cr.Misc. No.2732 of 2018(3) dt.17-02-2018 2/2 deceased and further specific allegation is against one Pawan Das of opening fire causing injury to the nephew of the informant but that allegation is not against the petitioner and there is property dispute between both sides and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, petitioner Mukesh Das is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Munger in connection with Naya Ram Nagar P.S. Case No.79 of 2017, giving rise to Sessions Trial No.277 of 2017.
