The petitioner has preferred this application for grant of regular bail in a case registered under sections 414, 467, 468, 471 and 120B of the Indian Penal Code and sections 30(a), 32(2) and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, a total of 2444.7 litres of IMFL was recovered from the truck of which the petitioner is stated to be the driver.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his vehicle. The petitioner has no criminal antecedent and is in custody since 25.11.2020. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and

No.25007 of 2021(3) dt.16-11-2021 2/2 taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Bachhawara P.S. Case no. 239 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd -cum-Special Judge (Excise), Begusarai.
