Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners, after some arguments, seeks permission to withdraw the anticipatory bail application with respect to petitioner Nos. 1 (Vidhya Nand Ram) and 3 (Rishi Kumar Ram @ Rishi Kumar).

Permission is accorded.

Accordingly, the instant anticipatory bail application is dismissed as withdrawn with respect to petitioner Nos. 1 and 3.

The petitioner No. 2 apprehends her arrest in a case
Patna High Court CR. MISC. No.13707 of 2025(3) dt.12-05-2025 2/3 registered for the offences punishable under Sections 103(1), 238 of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that a dead body with marks of injury was recovered on information from a bush near a canal. The learned counsel for the petitioner next submits that accordingly an FIR was instituted against unknown and during the course of investigation, one Bucchi Devi was arrested and she, in her statement, disclosed that she was approached by Vidya Nand Ram and he disclosed that the deceased is creating problems for his sister, as such, he intends to remove him from the scene, based on which Bucchi Devi got in contact with the deceased and thereafter called him in a fair and informed the accused persons and thereafter the accused persons including Vidya Nand Ram, Rishi Kumar Ram along with others including the petitioner came at the place of occurrence and thereafter Vidya Nand Ram stabbed the deceased to death and Rishi Kumar Ram was also present at the place of occurrence.

It is further submitted that Petitioner No. 2 is sister of Vidya Nand Ram with whom the deceased was in a relationship, as such, she has also been implicated in the instant
Patna High Court CR. MISC. No.13707 of 2025(3) dt.12-05-2025 3/3 case without any allegation of overt act. It is also submitted that informant is not an eyewitness to the occurrence. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the fact that petitioner is a woman, the petitioner, Sulekha Kumari @ Sulekh Kumari, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Rajnagar P.S. Case No. 389 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
