Mr.Gagan Deo Yadav For the Opposite Party/s :
Mr.Braj Kishore Pd.(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2019 This application has been filed for cancellation of anticipatory bail granted to opposite party No.2 by order dated 26.6.2018 passed by learned Additional Sessions Judge-VI, Madhubani in ABP No. 1101 of 2018.
The ground for cancellation is that by producing forged certificate opposite party No.2 has obtained bail. Heard both sides and from perusal of the impugned order it appears that learned Sessions Judge has called for a report from CMO, Madhubani and CMO, Madhubani vide letter No. 1569 clarified that the office was informed by Chikitsa Parishad that both letters regarding accused-applicant were found correct, as such he has been granted bail and there is
Patna High Court CR. MISC. No.19170 of 2019(2) dt.20-08-2019 2/2 nothing available on the record to show that letter No. 1569 issued by CMO, Madhubani on the basis of which report was called for by learned Sessions Judge is false and forged. In such view of the matter, I find no merit in this application. It is, accordingly, dismissed.
