Mr. SRI AMRENDRA PRASAD ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 06-03-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Katihar Rail P. S. Case No. 55 of 2017 registered for the offences punishable under Sections 401, 414 and 34 of the Indian Penal Code and 20 and 22 of NDPS Act and 137 and 147 of Indian Railway Act, 1989.

Informant, who is a police officer, has stated in his written report that while he was on patrolling duty at platform he saw two persons talking with each other and on seeing police they started to flee away. One of them managed to escape away but petitioner was apprehended and from his possession 15 ATVAN tablets, Rs.250/- in cash and other things were recovered.

It is submitted on behalf of the petitioner that he is

Patna High Court Cr.Misc. No.6888 of 2018(3) dt.06-03-2018 2/2 innocent and has falsely been implicated in this case. He had gone to Railway Station and only on suspicion he has been arrested. He is in custody since 12.5.2017.

Learned State counsel has opposed the prayer for bail. Considering the facts and circumstances of the case, I am not inclined to grant bail to petitioner, same is rejected. However, petitioner may renew his prayer for bail after completion of one year in custody.
