Heard Mr. Krishna Prasad Singh, learned senior counsel for the petitioner and the learned A.P.P. for the State. The petitioner seeks bail in connection with Obra P.S. Case No. 183 of 2020 registered for the offence under Sections 302, 201 and 34 of the Indian Penal Code. The petitioner along with others alleged to have committed murder of brother of the informant. Learned senior counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.23417 of 2021(2) dt.16-11-2021 2/2 this case. As a matter of fact, there was a land dispute between the parties and on account of the same, this petitioner has been made accused in this case. Moreover, the entire prosecution is based on suspicion and save and except the suspicion, no cogent material has come during course of investigation against the petitioner. Moreover, co-accused, namely, Basudeo Ram, has already been granted bail by a coordinate Bench of this Court vide order dated 07.09.2021 passed in Cr. Misc. No. 23486 of 2021. The petitioner is rotting in judicial custody since 20.12.2020. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Obra P.S. Case No. 183 of 2020.
