Petitioner seeks regular bail in connection with Kankarbagh P.S. Case No.237 of 2017 registered for the alleged offences under Sections 399 & 402 of the Indian Penal Code and Sections 25 (1) (b) (a), 26 and 35 of the Arms Act. As per the prosecution case, several accused persons were collected for preparation of looting of vehicle etc. Seeing the police party, petitioner and other accused persons managed to escape but two persons were apprehended and from whom arms and ammunitions were recovered. On the disclosure of the apprehended accused person the petitioner's name surfaced in this case.
It has been submitted by learned counsel for the
Patna High Court Cr.Misc. No.29550 of 2017 (02) dt.01-07-2017 2/2 petitioner that he has been falsely implicated in this case. There is no recovery from the conscious physical possession of the petitioner. There is no specific allegations against the petitioner rather the allegations are general and omnibus in nature. He has been languishing in jail custody since 09.04.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned J.M. 1st Class, Patna in connection with Kankarbagh P.S. Case No.237 of 2017.
