Mr.Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 379, 354(A), 307 and some other minor Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the FIR specific accusation of assault is against other accused persons. So far this petitioner is concerned, he along with 20-25 unknown persons are alleged to have trespassed into the house of informant and looted cash, jewelry and other house hold articles.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is general and omnibus allegation against this petitioner and no specific overt act has been alleged against him.

Patna High Court CR. MISC. No.13864 of 2022(2) dt.23-08-2022 2/2 Similarly situated accused Prabhakar Kumar has already been granted pre arrest bail by a co-ordinate Bench of this court vide order dated 18.01.2022 passed in Cr. Misc. No. 30309/ 2021. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Hilsa, Nalanda in connection with Hilsa PS case No. 240/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
