2. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 06.12.2022 passed in Criminal Miscellaneous No. 31359 of 2022.

3. Learned APP for the State opposes the prayer for bail and submits that the recovered contraband is less than the commercial quantity but above the small quantity.

4. Upon perusal of record, it transpires to this Court that the antecedent of the petitioner is not clean as he is accused in nine more criminal case and out of nine, two cases have been lodged under NDPS Act. The present case is also related to NDPS Act.

5. In the present facts and circumstances, I am not inclined to grant regular bail to the petitioner.

6. Accordingly, the prayer for regular bail of the petitioner in connection with N.D.P.S. Case No. 98 of 2021 arising out of Ahiyapur P.S. Case No. 478 of 2021, pending before the learned Additional Sessions Judge-II, Muzaffarpur is hereby rejected.
