2. The petitioners are apprehending arrest in connection with Masaurhi P.S. Case No. 338 of 2023 lodged on 19.05.2023, for the offence punishable under Sections 341, 323, 354(B), 504, 506, 442 & 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against five named accused persons including the present petitioners. It has been alleged in the FIR that co-accused namely, Gopali Kumar and Niranjan Kumar @ Natwar have tried to outrage the modesty of the informant. Allegation against the petitioners in the FIR is that they have assaulted the informant's parents and

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that petitioner no.1 is the mother of coaccused Gopali Kumar and petitioner no.2 is the brother of coaccused Gopali Kumar and only due to this reason, their name has been inserted in this case. Counsel submits that co-accused Gopali Kumar, Niranjan Kumar @ Natwar and the informant are student of same class and they are well known to each other. Counsel further submits that when the informant's parents received information that their daughter is in company with her boyfriend, then with a view to teach lesson, the present case has been lodged. Counsel further submits that petitioner no.1 has no criminal antecedent, but criminal antecedent of petitioner no.2 is not clean as there is one case pending against him in which he is on bail.
5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the Trial Court

No.15847 of 2025(2) dt.02-04-2025 3/3 within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Masaurhi, Patna, in connection with Masaurhi P.S. Case No. 338 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
