Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 469, 120B of the Indian Penal Code. It is alleged that petitioner no. 1 transferred the share of land of the informant in favour of petitioner no. 5 namely Brajesh Bharti @ Brijesh Bharti, whereas petitioner nos. 3 and 4 namely Biran Prasad and Mohan Bharti @ Mohan Bharati are witnesses of the sale deed. It is claimed by the informant that the share of the land of petitioner no. 1 namely Most. Yasoda Kuer by auctioned was sold during life

Patna High Court Cr.Misc. No.14062 of 2015 (2) dt.11-05-2015 time of grand-father namely Baldev Prasad.

It is submitted by the learned counsel for the petitioners that the petitioner no. 1 sold her share of land and the same was recorded in the name of petitioner nos. 1 to 3 in the Revenue record and partition suit is pending between the parties. Statement has been made in para-3 of the petition that petitioner nos. 4 and 5 have no criminal antecedent but supplementary affidavit has been filed to the effect that petitioner nos. 1 to 3 are accused in other cases in which they are on bail.

Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Manjhi P.S. Case No. 181 of 2014, pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.

With this observation this application is disposed of.
