In this case, the petitioner is seeking regular bail in connection with Sheikhopur Sarai P.S. Case No. 53 of 2022, registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120 (B), 34 of the Indian Penal Code. As per prosecution case, the SHO got an information that one co-accused Chandan Kumar is involved in deceiving people by alluring them for providing loan and providing jobs in Himalaya Company on their mobile phones. The place of occurrence was raided and Chandan kumar was apprehended and a number of mobile sets, sim cards, cheque books and PAN cards were recovered. The learned counsel for the petitioner has submitted that except confessional statement of Chandan kumar there is nothing
Patna High Court CR. MISC. No.14376 of 2023(2) dt.10-05-2023 2/2 against the petitioner. He is under custody since 02.01.2023 and he has no criminal antecedent. He has further submitted that on similar footing co-accused Guddu Yadav and Dheeraj Paswan have been granted bail by the coordinate Benches of this Court in Cr. Misc. No. 2905 of 2023 and Cr. Misc No. 55743 of 2022 respectively. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhopur Sarai P.S. Case No. 53 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
