JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 02.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner has been made accused for the offence registered under section 302/34 of the IPC for committing murder of wife of his younger brother. However, in course of investigation, it came to light that the statement of deceased was recorded in hospital and in the said statement, she stated against the petitioner as well as her husband. Husband of the deceased was put on trial and was convicted by the trial court. Husband of the deceased filed Cr. Appeal (DB) no. 775/2013 and he was granted bail by the Division Bench of this court. Moreover, trial court has reported that charge against the petitioner has already been framed and only one witness could be examined. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
