JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under various sections of N.D.P.S. Act. Petitioner is in jail custody since 30.04.2014 and submission on behalf of the petitioner is that up till now, only two prosecution witnesses could be examined. However, there are 19 proposed prosecution witnesses. The petitioner was caught by the informant and other police officials while he was driving a truck from which in huge quantity Ganja was recovered. The trial of the petitioner has already commenced as it appears from the submission of learned counsel of the petitioner.

No.26325 of 2017 (2) dt.12-07-2017 2/2 Therefore, I do not feel it proper to release the petitioner on bail and hence, his prayer for bail in connection with Special Case No. 39 of 2014 arising out of Economic Offence P.S. Case No. 26 of 2014 pending in the court of Special Judge cum 6th Additional Sessions Judge, Patna is again rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible. Let a copy of this order be sent to Senior Superintendent of Police, Patna with direction to him to ensure the presence of prosecution witnesses of aforesaid case before the trial court as and when it is required by the trial court.
