Earlier the appeal filed on behalf of this appellant was permitted to be withdrawn on the request of his learned counsel when it was found that the order taking cognizance and issuance of summons has already been passed by the learned Special Judge SC/ST, Gaya. There being a prima facie case against the appellant, prayer for anticipatory bail cannot be entertained on the face of the statutory provisions contained in the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. Mr. Sadanand Paswan, learned Spl.P.P. for the State is present. This application stands dismissed.
