====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 28-03-2025 Heard Learned Counsel for the petitioners and Learned APP for the State.
2. The petitioners are apprehending arrest in connection with Didarganj P.S. Case No. 218 of 2024 lodged on 20.06.2024, for the offence punishable under Sections 341, 323, 307, 504, 506 & 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioners against whom there is an allegation that they have assaulted the informant by rod due to which he sustained head injury.
4. Learned Counsel for the petitioners submits that the
Patna High Court CR. MISC. No.13464 of 2025(2) dt.28-03-2025 2/3 petitioners are innocent and have committed no offence. Counsel also submits that petitioner no.1 is the aunty of the informant and petitioner nos.2 and 3 are cousin brother of the informant. Counsel submits that informant is in a habit of drink alcohol and when he fell down in the drain then petitioners who are family members, have taken him out from the drain. Counsel further submits that petitioners have no criminal antecedent. Counsel further submits that injury report has been annexed as Annexure-P/2 by which it transpires that the injury is simple in nature.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that petitioners and informant are family members and the injuries caused to the informant is also simple in nature.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Patna, in connection with Didarganj P.S. Case No. 218 of 2024, subject to the conditions as laid down
