The petitioner is apprehending his arrest in connection with Chhatauni P.S.Case No.172 of 2016 , registered for offences punishable under Sections 384 and 387 of the Indian Penal Code.
Prosecution case is of demand of Rangdari by Mobile No.7464009734 from the informant . The petitioner is not named in the FIR. It appears that later on the police came to know that same was issued in the name of Gita Devi and Gita Devi has confessed that the SIM was being used by his son Ajay Mahto .
Submission of the learned counsel for the petitioner is that the materials collected during the investigation disclose
Patna High Court CR. MISC. No.12369 of 2019(4) dt.20-06-2019 2/2 that Ajay Mahto was working in the shop of the father of the petitioner and as he was ousted from the shop , he has named the petiotner in the present case. He has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari ,East Champaran in connection with Chhatauni P.S.Case No.172 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
