The petitioner seeks bail in Siwan (T) P.S. case No. 342 of 2016 under Section 401, 423, 414/34 of the Indian Penal Code.

The police arrested two persons, namely, Alok Kumar @ Prince Kumar, the petitioner, and Bullet Ram. From the possession of petitioner one Apache motor cycle, ATM card and Rs. 25,000/- cash were recovered. From the possession of Bullet Ram one TVS motor cycle was recovered.

The learned counsel for the petitioner submits that cash and ATM card were released in favour of the petitioner. The motor cycle is yet to be released. The petitioner is in jail since 06.05.2016. The petitioner has already remained in jail for 14

Patna High Court Cr.Misc. No.27043 of 2017 (3) dt.11-07-2017 2/2 months.

Considering the nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for 14 months and co-accused Bullet Ram has already been granted bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Siwan (T) P.S. Case No. 342 of 2016.
