JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Ballia P. S. Case No. 188 of 2018 dated 05.07.2018 instituted for the offences under Sections 30(a), 32/41(i) of the Bihar Prohibition and Excise Act, 2016.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed, the court below shall take into account that the petitioner is not named in the F.I.R. and nothing has been recovered from his possession
