1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 323, 307, 332, 333, 337, 338, 353, 427, 504 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant (SHO, Ram Krishna Nagar Police Station) alleges that on 19.06.2023, the police personnel were doing their duty in the police station when, at about 03:30 p.m., 100-150 accused of village Bhupatipur Mushari gathered near the police station and started abusing the police personnel and also created ruckus and resorted to pelting of stones on account of which Sub-Inspector
Patna High Court CR. MISC. No.19567 of 2025(2) dt.23-04-2025 2/3 of Police, namely, Shambhu Nath Singh sustained injury on his head. Further, when the additional police force came the accused persons fled away after creating ruckus inside the police station.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case in order to coerce the family members of Chotu Manjhi, the uncle of the petitioner who was arrested by the police officials of the aforesaid police station who died on 18.06.2023 in PMCH on account of torture meted out to him while he was in judicial custody. It is thus submitted that petitioner has been falsely implicated in the instant case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Ramkrishna Nagar
