Petitioner, already in custody, seeks bail in connection with Mahila P.S. Case No.22 of 2017, registered under Sections 376, 366(A), 504, 506 and 120(B) of the Indian Penal Code as well as under Section 4 of the POCSO Act.
Allegation in brief is that the petitioner developed relationship with the prosecutrix by calling repeatedly on her mobile and promised to marry her and one day at 11 P.M. in the night, the prosecutrix went along with him and thereafter she was raped and left her at a place.
It is contended by learned counsel for the petitioner that the alleged date of occurrence of committing rape is 24.05.2017 but
Patna High Court Cr.Misc. No.17382 of 2018(3) dt.28-03-2018 2/2 case is lodged on 09.06.2017 at much belated stage and the medical report shows no recent sign of commission of any rape or any mark of violence rather she was found habitual in sexual relationship and the girl is major.
Having considered the aforesaid facts and circumstances, petitioner Amrendra Singh @ Amrendra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 1stcum-Special Judge, POCSO Act, Aurangabad in connection with Mahila P.S. Case No.22 of 2017.
