The petitioners seek bail in connection Jamalpur (Bargoan O.P) P.S. Case No. of 105 of 2023 instituted for the offence under Sections 363, 366(A), 385, 504, 506 & 34 of the Indian Penal Code. Earlier vide order dated 02-08-2024 passed in Cr. Misc. No. 42239 of 2024, anticipatory bail of the petitioners were rejected.

Prosecution case is that sister of the informant was abducted by the petitioners herein and they had demanded

It has been submitted on behalf of the petitioners that the petitioners are in custody since 22-10-2024. Petitioners bear no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. Learned counsel for the petitioner submits that, admittedly, petitioner No.2 and the victim was in love and victim eloped with him at her own volition. It is stated by petitioners' counsel that compromise petition has been filed in the court below on 07-01-2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. Victim in her statement recorded under Section 164 of the Cr. P.C. has fully supported the prosecution case. The accused persons also prepared video of victim.

Considering the aforesaid facts and circumstances of the case and specifically taking into account the fact that victim has supported the prosecution case in her statement recorded under Section 164 of the Cr.P.C., this Court is not inclined to grant bail to the petitioners. Prayer of grant of bail to

The Trial Court is directed to expedite the trial as expeditiously as possible on day-to-day basis without any undue delay and unnecessary adjournments.
