Petitioner seeks bail in connection with Sessions Trial No.16 of 2017, arising out of Kathaiya P.S. Case No.22 of 2013, registered under Sections 147, 148, 149, 341, 323, 324, 379, 302 and 120(B) of the Indian Penal Code, pending in the court of the Additional Sessions Judge-VII, Muzaffarpur.
Learned counsel for the petitioner submits that, earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 23.03.2017 passed in Criminal Misc.No.27638 of 2016 on merit. Petitioner is in custody since 02.04.2016. Further submission is that in course of investigation, it has come that on the alleged date of the occurrence, the petitioner was on duty at Delhi, as detailed in paragraphs 72 and 73 of the supplementary

Since the prayer for bail of the petitioner has already been rejected by this Court on merit vide order dated 23.03.2017 passed in Criminal Misc. No.27638 of 2016, I find no reason to reconsider the prayer for bail of the petitioner. Accordingly, the prayer for bail of the petitioner is again rejected. (Rajendra Kumar Mishra, J) AnilKrSinha/- U
