Petitioner, already in custody, seeks bail in connection with Sugauli PS Case No.197 of 2017, registered under Sections 364 and 365/34 of the Indian Penal Code. Later on Sections 302, 201 and 120(B) of the Indian Penal Code were also added. Allegation in brief is that the son of the informant was called by some unknown person on mobile and thereafter he did not return back and later on his dead body was found. Learned counsel for the petitioner submits that the petitioner has been implicated in this case merely on the basis of confessional statement made before the police and on the basis of the CDR that the petitioner talked with the wife of the deceased, the petitioner is the brother-in-law of the deceased and only

Patna High Court Cr.Misc. No.12540 of 2018(3) dt.19-04-2018 2/2 suspicion is raised against him of killing the deceased on account of having illicit affair with deceased's wife on the basis of confessional statement and similarly situated another co-accused Vijay Sah @ Vijay Kumar Sah has been admitted to bail by this Court vide Cr. Misc. No.9228 of 2018 on 16.03.2018. It is also submitted that the wife of the deceased has filed petition that the confessional statement was forcefully taken by the police. Learned counsel appearing on behalf of the informant opposed the prayer of bail and submits that there is confessional statement of the wife of the deceased and learned counsel for the informant refers paragraphs 66 and 67 of the case diary. Having considered the aforesaid facts and circumstances, petitioner Ramesh Sonar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Sugauli PS Case No.197 of 2017.
