Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Ara Nagar P.S. Case No. 150 of 2017, registered for the offences punishable under Sections 406, 420, 120(B) and 34 of the Indian Penal Code.
Prosecution case in brief is that informant is a retired army personnel and he used to live in his village. The accused persons opened a branch of DJN Group of Companies in Ara town. They convince the informant and others to deposit their money in their company and they will give 4 to 10% profit on their deposit money and whenever they want to withdraw their money they can do so. The informant deposited money of Rs.
Patna High Court CR. MISC. No.11394 of 2020(2) dt.24-06-2020 2/2 882305/- in the aforesaid company. Later on, the informant came to know that the accused persons had closed their company and fled away after taking money of the informant and others.
It is submitted that petitioner has been falsely implicated in this case. Name of this petitioner has come in this case only because he is relative of one of co-accused. There is general and omnibus allegation and nothing specific against this petitioner.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara Bhojpur in connection with Ara Nagar P.S. Case No. 150 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
