2. The petitioner seeks bail in connection with Beldaur P.S. Case No. 37 of 2022 registered for the offence under Sections 392 of the Indian Penal Code.

3. As per the prosecution case, four unknown persons assaulted the informant and looted his motorcycle, mobile phone, ATM Card, Trolley and purse containing Rs. 3,000/-. later on informant came to know that Shailendra and Ashish(Petitioner) of Kainjari village had committed the crime.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 26.06.2022, he has falsely been implicated in this case and the petitioner is quite innocent.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.14015 of 2023(3) dt.28-07-2023 2/2 prayer for bail.

6. I have considered the submissions of the parties.

7. The looted motorcycle has been recovered from the house of the petitioner.

8. His participation in the alleged crime is confirmed.

9. In these circumstances, I am not inclined to grant bail to the petitioner.

10. Accordingly, this application is dismissed.

11. The Court below is directed to expedite the trial of the petitioner.
