JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Shri Upendra Kumar, the learned advocate for the petitioner and learned APP for the State. The petitioner is seeking regular bail in connection with Kalyanpur P.S. Case No. 31 of 2017 registered for the offences under Sections 272 and 273/34 IPC read with sections 30 and 38 of the Bihar Excise Amendment Act, 2016. The prosecution story as disclosed in the self statement of the S.I. of Kalyanpur Police Station, so far as the present petitioner is concerned, is that he was there on the line hotel and on seeing the police party he was one of the accused who attempted to flee away. The seizure list would show a recovery of Rs. 18,000/- in cash from the petitioner.
Patna High Court Cr.Misc. No.25330 of 2017 (2) dt.07-06-2017 Learned counsel for the petitioner submits that the petitioner was not found sitting in the alleged truck in which the illegal liquors were allegedly being transported for supply. He would further submitted that the petitioner is in custody since 11.3.2017 and the investigation in the present case is over. The learned APP opposed the prayer for bail.
In the facts and circumstances stated hereinabove, let the petitioner, namely, Nitesh Kumar @ Nitesh Kumar Singh be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Samastipur in connection with Kalyanpur P.S. Case No. 31 of 2017.
